DOCUMENT CHECKLIST FOR ESTATE AGENTS WHEN INSTRUCTING THE TRANSFERRING ATTORNEY:
1. Offer to Purchase
*The following information must be included in your Offer To Purchase:
1.1 Name of Seller.
1.2 Name of Purchaser.
1.3 Purchase Price.
1.4 Identity number of Seller and Purchaser.
1.5 In the case of a legal entity, the Company/Trust or Close Corporation’s registration number.
1.6 Confirmation whether the Purchaser is paying cash or whether the Purchaser will apply for a bond in order to cover the purchase price.
1.7 Marital status of the seller and purchaser.
1.8 Estate agents commission.
1.9 Existing bond account number.
1.10 Municipal account of the property being sold (Account number).
1.11 Electrical certificate, Electric fence certificate and Gas certificate to be supplied by the Seller (if applicable).
1.12 Body Corporate / Home Owners Association details (if applicable).
1.13 Copy of marriage certificate of Seller and purchaser or if divorced copy of Divorce Order with Settlement Agreement.
1.14 Subject to sale (Is the purchase of the property subject to the Purchaser Selling his/her property).
1.15 Occupation (When will the Purchaser take occupation and will occupational interest be payable on early occupation?).
1.16 Seller’s declaration confirming whether there are any current defects in the property.
1.17 Transfer (Who did the seller appoint as the transferring attorney?).
1.18 Sold Boards (Is the Agent allowed to place a sold sign in front of the property?).
1.19 The Seller’s and Purchaser’s chosen domicilium address for the purpose of serving notices.
1.20 Other conditions (What repairs need to be done to the property and what will remain on the property after the property has been successfully registered into the new purchaser’s name).
1.21 Cooling off period (The application of the Alienation of Land Act, as well as the Consumer Protection Act).
2. Seller Documents
*The following documents must be supplied by Seller:
2.1 ID document.
2.2 FICA documents (Municipal statement, not older than 3 months, alternatively any account reflecting the Seller’s physical address).
2.3 SARS reference number / tax number.
2.4 Antenuptial contract / marriage certificate (if applicable).
2.5 Existing bond account number (if applicable) alternatively the original Title Deed: Please ensure that you as the Agent keep a receipt of acceptance of the original Title Deed.
2.6 Electrical Compliance Certificate (ECC).
2.7 A copy of the pre-paid card number as well as the current meter reading.
2.8 Gas certificate (if applicable).
2.9 Electrical fence certificate (if applicable).
3. Purchaser Documents
*The following documents must be supplied by Purchaser:
3.1 I.D document.
3.2 FICA documents (Municipal statement, not older than 3 months, alternatively any account reflecting the Purchaser’s physical address).
3.3 SARS reference number / Tax number.
3.4 Antenuptial contract / Marriage
